Re: Wiltshire at Oxford Subdivision Sidewalks
Dear Supervisors Levandowski, Shelton and Olivieri,
My name is Lynley Thinnes.
I am the President of the Wiltshire at Oxford Homeowners Association.
We are in receipt of a letter dated June 9, 2006 between the Township
Board of Supervisors and William Romanelli on behalf of Charles Wilkinson (see
attached). In this letter
Wilkinson maintains that the condition of the sidewalks in the Phase I side
(per official plans Phase I and II) of spalling is caused by the application
of salt and is not a structural defect. He is offering a sum of $20,000 to resurface the spalling
sidewalks, provided this is not a condition of repair for the dedication of
Phase II (per official plans Phases III, IV and V).
We are in vehement disagreement with Mr. Wilkinson’s
assessment that the spalling is not a structural defect especially since
>40% of our sidewalks throughout the community have structural defects with
the majority being spalling. We
believe this condition to be due to defective concrete and poor workmanship,
not salt application. Areas that
have never been salted are showing signs of spalling.
We have been trying to get resolution on this issue for several years.
Spalling was evident on repairs done as part of the Phase I dedication
(for Phase I and II). These
repairs are deteriorating less than 18 months after they were supposedly
fixed. If they had been done
correctly this should not be occurring.
We have hired an independent laboratory specializing in
concrete to inspect all of the sidewalks within the community and conduct the
appropriate analyses on core samples to determine the cause(s) of the
defective sidewalks. This testing
is ongoing and should be available in the near future.
On June 30, 2006 we had a meeting with David Shelton to
discuss the conditions of our sidewalks.
In attendance at this meeting were Angela Miller (Board VP), Theresa
Campbell (CCR Management) and myself. We shared the preliminary reports from
the independent laboratory with Supervisor Shelton. He indicated that he and the other supervisors were unaware
at that time as to the pervasiveness of the situation.
Wiltshire at Oxford believes that the amount that
Wilkinson is offering to fix the spalling on the Phase I/II side is inadequate
and we will not accept it. We
believe the cost will be significantly higher to make the proper repairs for
sidewalks with spalling. We
believe these sections will need to be removed and re-poured, not just
resurface them.
We are urging the Supervisors to not accept this offer
and take the following into consideration prior to the dedication for Phases
III/ IV / V:
- Allow
us time to complete our investigation (all results will be provided to the
township),
- Allow
us time to have an independent assessment of repair costs in order to
determine the amount for proper repairs on Phases I and II in order to be
appropriately compensated,
- Have
the township include spalling as one of the structural defects that needs
to be replaced, not just resurfaced as part of the condition for taking
dedication for Phases III/ IV/ V
- Require
some guarantee that the repairs performed as part of dedication of Phases
III/ IV / V or the current repairs to Phase I /II will not deteriorate
before the customary life of sidewalk concrete.
We will be happy to come in and discuss this further.
We plan to share all of our findings with the Township as soon as they
are available. If you have any
