The Board has dealt with a number of issues this year so far.    The primary issue has been the sidewalks as we noted in the open board meeting in October, the Board decided to go ahead and have an analysis performed on the sidewalks to assist the fight to get the sidewalks repaired.  All homeowners will have access to this report once available. 
We commissioned Valley Forge Laboratories to perform testing on our sidewalks.  Preliminary results suggest that we have defects and poor workmanship.  On June 11, 2006 we received a copy of a letter wherein Wilkinson offered  $20,000 to the ENT for the resurfacing of Wiltshire's spalling sidewalks.  A condition of this offer was that the spalling condition was to not be considered a defect on the Phase II side when it was dedicated.  The board did not agree with this offer or conditions and pursued several meetings with various members of the East Nottingham Township Board of Supervisors, Ron Ragan (Ragan Engineering), PJ Scheese (Zoning) and Bill Weaver (Road master) to further discuss the sidewalks in our community.  Additionally a letter was sent to the board of Supervisors on July 10, 2006 formally requesting that they not accept Wilkinson's offer. 
I attended the Board of Supervisors' meeting on July 11, 2006 where our letter was discussed.  A copy of it is on the web site.
We had Mr. Ragan clarify the sequence of events as they pertain to our sidewalks to better understand our situation.
Phase I (officially per their documents this is Phases I and II of five)
Phase I was dedicated by the township on September 16, 2002.  As part of the dedication, the sidewalks were visually inspected and repairs made. A Maintenance bond was held for 18 months, which expired in Spring 2004.   Another inspection of the roads sidewalks etc was conducted in spring of 2004.  At that time about 5% of the sidewalks showed signs of spalling.  The inspection was visual only; no physical testing was performed. At that time they were told that is was due to salt and no physical testing of the sidewalks was conducted.  Wilkinson was not found to be at fault and ENT did not hold him accountable.  Since the time has expired, the ENT does not feel that they have any recourse to help us on the Phase I side.

What is Loss Assessment Coverage?  This valuable coverage is uniquely designed for owners in condominium or homeowner associations. It recognizes the potential for owners to be assessed for certain kinds of loss. Here are examples of circumstances that might require the condominium or homeowner association board to assess all units: Some is seriously injured on common property (perhaps on the sidewalk) and the courts award a judgment that is higher than the amount of liability coverage provided by the condominium or homeowner association policy. Major damage occurs to commonly owned buildings or facilities and it is not fully covered by insurance.
In either case (and in similar cases), loss assessment coverage would pay your share (up to a stated amount). You should review the need for this coverage with your agent and buy an appropriate amount of coverage.  The board is evaluating higher coverage, but we recommend that you seek your own policies as well.

Arch Committee Update

We would like to remind you that the Community Declaration and Rules & Regulations contain specific requirements that need to be met before proceeding with exterior projects.  Before beginning any projects an Architectural Approval Request Form must first be submitted to the ARC and approval obtained.  A copy of the form can be obtained on the website. Copies of the Rules and Regulations (Revised March 2006) were circulated to all in the community early this year and are available on the website. 

The main purpose of architectural submissions is to ensure that the changes are in compliance with the document requirements, enhance property values, maintain the aesthetic appeal of the community, and promote harmony among homeowners.

Complaints for violations of the rules and regulations or the Covenant and declarations must be made in writing for the board to act with the name of the person making the complaint.  In cases where safety is a concern the board may act prior to the written complaint being completed.  All complaints must have your name identified, however these can be submitted to CCR in a fashion that is anonymous to the board and it's members.  This can be done through the web site address, which goes directly to CCR or, by fax directly to CCR.
